Principles of processing

Easly processes personal data on the basis of the medical treatment agreement which is regulated in the WGBO.

Personal data we process

Easly processes your personal data because you use our website and/or because you otherwise provide it to us yourself. Below is an overview of the personal data we process:

  • First name;
  • Last name;
  • Email address
  • Street name;
  • House number;
  • Zip code;
  • City;
  • Country;
  • Gender;
  • Date of birth;

  • Test results;

Special personal data

Some personal data is extra sensitive because processing it can have a great impact on a person’s life. Data that says something about a person’s health is special personal data. At Easly medical data are processed. This data is extra protected by law.

 

Exception to processing ban on special personal data
Article 9(2)(h) AVG jo. Article 30(3)(a) UAVG: the processing is necessary for the provision of health care and proper care by Easly. This exception applies to personal data processed from the citizen in the context of the execution of the medical treatment agreement, including taking the test and communicating the test result.

 

Processing of legal identification number
The processing of the legal identification number is permitted under the following legal provisions:

 

Wabvpz
Pursuant to Article 5 (1) of the Wabvpz, a healthcare provider within the meaning of the Wkkgz must establish a client’s identity and Citizen Service Number when the client first applies to the healthcare provider to obtain care.

 

Pursuant to Article 6 (2) of the Wabvpz, a healthcare provider shall include in its records the nature and number of a document referred to in Article 1 of the Compulsory Identification Act.   Pursuant to Article 8(1) of the Wabvpz, a healthcare provider includes the client’s Citizen Service Number in its records when recording personal data related to the provision of care.

Purpose of processing your personal data

  • Sending the test;
  • Analyzing the test;
  • Link the test result to the citizen’s personal data;
  • Communicate the availability and result of the test result to citizens;
  • Initiate a medical treatment agreement;
  • Meeting the legal obligations of the controller under other laws.

Who does your personal data end up with?

  • As a data controller, we are free to use so-called “data processors.” A processor is a natural or legal person who processes personal data at the request of or on behalf of the controller. The processor shall always act in accordance with the instructions of the controller.

Easly employs the following processors:

  • Companies and individuals we have engaged for hosting purposes;
  • Companies and individuals we have engaged for administrative purposes;
  • Two laboratories are called in to analyze the test and the test result, being Medical Laboratories Stein and Mozand lab;
  • The attending physician.

All processors listed above are required to respect the security and confidentiality of your personal data. A processing agreement is in place with all of these processors for this purpose. This includes what they may do with your personal data.

How long do we keep your personal data?

  • 20 years from the last change in the medical record, unless the client asks us to keep it longer / delete it earlier (ID verification required);
  • Anonymized data may be kept longer than 20 years if used for training/research;
  • Transaction data 5 years.

What are your rights?

  • The right to information, to inform the data subject about what personal data and for what purpose the personal data are processed;
  • The right to inspect and copy that data (to the extent that it does not violate the privacy of another);
  • The right to correct, supplement or delete data if necessary;
  • The right to request (partial) destruction of your medical records;
  • The right to oppose the processing of your data in certain cases;
  • The right to add a self-declaration (of a medical nature) to your file;
